Terms & Conditions of Sale
These terms and conditions of sale constitute a binding contract between, you the customer and Fireside Place. The customer accepts these terms and conditions of sale by making a purchase, placing an order by phone, fax, mail, e-mail or internet.

ORDERS: Our terms are 100% with your Internet order. Credit card will be charged at time of placing order over the phone, fax, mail, e-mail or internet. METHOD OF PAYMENT: We accept Visa, MasterCard und Discover, USPS Money Order, Bank Transfers, Cashier's Checks or Certified Bank checks issued by a USA bank.
SHIPPING/FREIGHT CHARGES: Although we quote you a time frame for your shipping schedule, this is approximate due to the nature of our business. Shipping times may vary from more to less depending on many variable factors. We try very hard to match our Products schedule with our sales department's volume but exactly sychronizing both is not always possible. Products shipped within some areas such as the five boroughs of New York, Long Island, Martha's Vineyard or to other restricted access areas an additional charge will apply depending on shipping company. This is due to the transportation surcharge or transport for delivery to these areas. We will notify you of the cost before processing your order, if these conditions apply, and you may accept or cancel the order based on these conditions.
EXCHANGES/RETURNS: We want you to be totally satisfied so we have the simplest policy you have ever seen! You may return anything you are not satisfied with for any reason for a refund within 30 days (except custom made to order items, see below). We will deduct for our original actual cost of shipping (not any discounted shipping such as using our product configurators, etc.). You pay return shipping costs and we refund you your purchase price less the actual original cost of shipping it to you. If we made a mistake we pay the shipping back and refund you you full purchase price including the original shipping cost. The item(s) must be just like you received it, unused and with the same packaging. Custom made to order items are unique to a customer and therefore are non-returnable. Do not return any merchandise for any reason without first e-mailing our customer service department. All unauthorized returns will be refused at our dock. We are not a "try out service". Once you have purchased an item from one of our web sites an exchange may be permitted (at our discretion, rather than going through the manufacturer's warranty process) for an item found to have genuine manufacturer defects at the time it was received from the shipping carrier. We are very customer service oriented but have had some abuses of our generosity and efforts in the past. Customer is responsible for returning the item in the original packaging and in sealable condition. All returns must include original factory box, original factory packaging (foam, plastic, plastic on frame, wrappings, etc) blank, unfilled warranty cards, all instruction booklets and paperwork, along with a copy of your invoice. Do not deface original factory cartons or packaging in any manner. Please properly package and insure the item. Goods are to be returned shipping prepaid. ALL EXCHANGES MUST BE AUTHORIZED BY US AND AN RMA NUMBER (Exchange Merchandise Authorization) MUST BE ISSUED. NO EXCHANGE WILL BE MADE ON MERCHANDISE RETURNED WITHOUT AUTHORIZATION. Any "Shipping Included" (Free Shipping) items will have the outbound freight charge deducted from the total refund. Many items have promotional (reduced) shipping charges - the shipping cost on your order may not reflect the actual shipping cost. RMA void if product is not returned within 10 days of RMA being issued. There will be a 50% restocking fee for allowed merchandise returned to our warehouse.
DEFECTIVE MERCHANDISE: Merchandise that becomes defective within the warranty period will be subject to the manufacturer warranty terms and conditions. It is sometimes necessary to bill for all replacement parts and units and the credit once the defective merchandise is returned directly to the manufacturer and we issue credit to our customers when manufacturer issues credit to us. This process can take up to 4-6 weeks. The shipping cost on defective parts and units will be the responsibility of the customers as the manufacturer warranty does not cover shipping. All replacement parts and products will be billed to the credit card. We will credit the card once defective or damaged products are returned.
MADE TO ORDER MERCHANDISE:
Although we make the product to look like the picture of the item you purchased, the custom built items and products we manufacture are construction items made one at a time with a combination of factory machines and hand made processes, which results in differences of color, texture, design, style, and dimensions. Just one example: Tile availability is always changing so we use the closest match available to us at the time of Products. If you want very detailed and exact results you are responsible for having us put that in writing on your purchase order and/or supplying us with physical samples because, for example, computer monitors vary in their representation of color.
RISK OF LOSS OR DAMAGE All items purchased from our website are made pursuant to a shipment contract. This means that the risk of loss or damage and title for such items pass to you, the buyer, upon our delivery to the carrier. The shipment will leave our dock in perfect condition. If manufactured by our company it will be built to completion as per our website description and/or any adjustments discussed with the buyer. The carrier will not be liable for shipping damage or shortage not noted on the delivery receipt. If you received damaged merchandise and need to file a claim, please contact a sales associate. Do not refuse the goods as the refund money will come from the carrier, not us, so so try to take pictures of any and all damage if you can. Also make sure you mark the delivery receipt DAMAGED. All shortage or damage must be reported by email or faxed within 48 hours of receipt. START THE DAMAGE CLAIM RIGHT AWAY. WRONG ADDRESS SUPPLIED: If customer misrepresents the delivery address as a business address and it is in fact a home business in a residential area all residential charges made by trucking/delivery company will be the responsibility of the buyer/customer and back charged to your credit card or reflect in your invoice. Any address correction done by FedEx, UPS, DHL or any other carrier due to misrepresentation on order form by customer will reflect in a back charge and customer will be sent an invoice. CANCELLATION FEE: No changes (except by mutual agreement) or cancellations are accepted for any reason on orders once placed by phone, fax, mail, e-mail or internet after 24 hours including, but not limited to, shipping schedules as there are too many reasons to list here that can affect your delivery date. Where no dispute was made within 24 hours of your order, your acceptance of the terms and conditions is assumed. If order is canceled or changed within the first 24 hours a 10% cancellation fee will be accessed. OPEN ACCOUNTS: Any account without an approved credit application on file with The Fire Side Place, will require PREPAYMENT. Standard terms for credit on approved open accounts are NET 30 Days. Payment is to be made according to each invoice. Late invoices will be charged 1-1/2% per month or 18% per annum. Any collection charges will be in addition to this interest. COLLECTIONS: A 30% collection fee will be added to all accounts that are found to be uncollectible and forwarded to our attorney. This will also apply to purchases made with invalid credit cards or credit card stop payments that do not comply with our terms and conditions. WARRANTY: Refer to manufacturer's specification - We are not responsible for manufacturer defects. All warranty claims have to be supported with pictures of the problem or broken/damaged part, no claim will be handled/accepted if no documentation is provided. NOTE: Warranty does not cover shipping cost or labor, only cost of part that has to be replaced.. LOCAL CODES AND REGULATIONS: It is the customer's responsibility to research and know if the products sold on our web site can be used in your local area. We are not responsible for items that are purchased that cannot be used due to codes or restrictions. We do not accept returns due to customer error of any kind. USE & MIS-USE LIABILITY POLICY: By purchasing from our website, the customer agrees to assume all responsibility for the safe and proper installation and use of the product(s) purchased. The buyer also agrees to release The our company from any liability that may arise from improper installation, use, abuse neglect or lack of preventive maintenance of the purchased product(s).
ERRORS ON OUR WEBSITE: We make every effort to ensure that the information on our website is accurate, complete and current. Despite our efforts, there may be instances when information about a Product contains inaccurate or incomplete data, including data about the Product's price or availability. The Fire Side Place. makes no warranty or guarantee that the information on our website is error free, complete or current. We reserve the right to correct errors, and/or update the content on on our website at any time without notice. The Fire Side Place. also reserves the right to refuse or cancel any order containing any error or inaccuracy, including after the order has been submitted, whether or not order has been confirmed and your credit card charged. If your order is canceled after your payment has been processed, we will issue a full refund to the original pay type.
Note: Failure to follow these procedures may result in forfeiture of monies due to you. Any damage or loss incurred in transit is the responsibility of the carrier. All claims have to be supported with pictures broken/damaged part, invoice number and name of purchaser, no claim will be handled/accepted if no documentation is provided. In some instances we need to have the damaged goods sent back to us in order to send you a replacement.
